
EVICTIONS
The following guidelines have been set by the Sheriff’s Office to ensure prompt and efficient scheduling and completion of evictions (Warrant of Restition).
Plaintiff/ Landlord / Agent
Evictions are scheduled on a first come, first served basis for the open dates. Evictions will not take place on weekends, holidays or outside of court hours. The Civil Process Unit will notify the landlord of the date and time. If the landlord is unable to proceed on the assigned date and time, they must contact the Civil Process Unit to request rescheduling to the next available date.
On the day of the eviction:
The landlord or agent must be present at the time of the eviction.
The landlord must provide the following:
1. A moving crew of at least:
•6 people for a one bedroom apartment
•8 people for a two bedroom apartment
•10 people for a three bedroom apartment
•12 people or more for a townhouse or single family house
•15 people or more for a business
The above numbers may be adjusted by the Sheriff’s Office based on the knowledge of the number of items in the residence or business.
2. The landlord is responsible for providing a certified locksmith if a key for entry is not available.
3. The landlord is to provide enough trash bags for removal of property and tools to disassemble furniture, if necessary.
**If sufficient help or supplies are not on scene at the time of the eviction, it will be rescheduled for a later time and date for the landlord to have the appropriate help. These requirements are in place to ensure that the eviction is completed in a timely manner.
If property is removed from the premises, the tenant is given 24 hours to collect their property. After 24 hours it is the responsibility of the landlord to remove any remaining items.
Tenant
When the eviction has been scheduled, the Warrant of Restitution will be posted on the premises with the scheduled date and time. This will be the only posting.
The date and time are provided as a courtesy and are subject to change. If the date and time has changed, you can seek to gather that information from your landlord.
It is the tenant’s responsibility to satisfy the judgement or vacate the premises before the date of the eviction in order to avoid eviction.
Weather
The following weather conditions will cause evictions to be rescheduled:
1. A temperature or next day forecasted temperature of 32 degrees Fahrenheit or lower
2. A winter storm warning or blizzard warning issued by the National Weather Service
3. A hurricane warning or tropical storm warning issued by the National Weather Service
4. An excessive heat warning issued by the National Weather Service
Evictions may also be postponed if there is precipitation at the time of the eviction. If precipitation occurs after the start of the eviction, the eviction will continue.
